Article 1 Purpose

This is the rules for using “Wolfgang's Steakhouse Gift Card” issued by Wolfgang's Steakhouse JAPAN Co., Ltd. (below “our company”). Wolfgang's Steakhouse Gift Card users (below “customers”) are assumed to deal with the transactions as per this agreement.

Article 2 Definition

■Wolfgang's Steakhouse Gift Card
This is the prepaid card issued by our company, substituting the value of money with the electronic data, and provides the functionality for buying products and receiving the provision of services at the shops specified by our company with the amount charged in advance (below “Card”).

Article 3 Available shops

The card can be used for payment at Wolfgang's Steakhouse Gift Card dealer shops in Japan. You can check our shops’ and our company’s website for more details such as the card dealer shops and their locations.

Article 4 Card issuance

1. The card is issued by the card dealer shops, and it is written as “Issued by Wolfgang's Steakhouse JAPAN Co., Ltd.” on its surface.
2. Our company takes the charged amount from the customers while issuing the card, and charges it to the card. It is also possible to take the newly charged amount after issuing the card, and then charge (recharge) the amount to the card.

Article 5 How to charge

1. Charge to the card can be done at the card dealer shops.
2. Charge to the card can be done with cash, credit card or the means of charge specified by our company.
3. Charged amount to the card is 10,000 Yen for each time, and the maximum charged amount is 50,000 Yen.

Article 6 Card usage

1. When the customer pay by the card, the customer give the card while making payment at the card dealer shops. The total amount of the products purchased is deducted from the charged amount of the card, and same as the payment by cash. The customer can check the total purchasing amount and the remaining balance of the card written on the receipt.
2. If the balance in the card given is insufficient for the total amount of products purchased, the deficit amount can be paid with cash or the means of payment specified by our company.
3. Although the several cards can be used during the payment, the deficit amount can be paid with cash or the means of payment specified by our company.
4. Although you have the several cards, the total balance of these cards can’t be integrated into that of 1 card.

Article 7 Card’s balance inquiry

1. The card’s balance is written on the receipt when the payment is done with the gift card, it can also check on our company’s website.
2. When checking the balance on our company’s website, 16-digits card no. and 4-digits PIN no. written on the card’s surface is required.
3. Not only the balance, the usage history can also be checked on our company’s website. However, the contents of the usage history and no. of records to be displayed on the website are decided by our company due to the system’s convenience.
4. The balance of the expired card can’t be checked.

Article 8 Exchange the card for cash

The card can’t be exchanged for cash.

Article 9 Reissuance

1. If the card is lost, stolen or falsified, we can’t do the breakdown (stopping functioning), refund or reissuance for this card.
2. Since the card and the functionalities of the card might be damaged, do not to stain, bend the card or do not to place the card near the magnet. If the card or the functionalities of the card is damaged, a new card with the shifted balance will be issued by our company’s judgment only if it is clear that the damage has been caused unintentionally, and the magnetic info. of the card and the card no. written on the back side of the card is readable. In this case, our company will exchange it with the new one, and requested you to give back the old one. Furthermore, the pattern and attributes of the new card will be specified by our company, and the customer cannot say objection. No refund will be conducted.

Article 10 Illegal acquisition, use, etc.

1. If it comes under any of the following conditions, our company won’t permit the user to use the card, the card will be handled as the expired card, and the customer must give back the card to our company.
①If the customer acquires the card with illegal means,
 or he/ she uses the card even if he/ she knows that it is acquired with illegal means
②If the card is falsified, counterfeited or altered
③If it violates this agreement
④Other cases : If this card is used illegally

2. If it is suspected to be under one condition of the preceding clause, our company can take back the card temporarily for investigation.
3. Furthermore, if the card is expired under the conditions of this clause 1, no exchange, reissuance or refund will be conducted by our company.

Article 11 Card’s expiry date

The expiry date of the card is 1 year after the charge or last use. If any card is expired, disable this card and no refund for the balance even if it has the remaining balance. Moreover, the expiry date of the card can be checked on our company’s website with PC or mobile phone.

Article 12 System maintenance, failure, etc.

Although the design and management of the card system are absolutely ensured, there might be partly or fully temporary stop of the service (card use) in some dealer shops or all dealer shops without prior notice due to electricity breakdown, system failure, maintenance, safety management in response to card counterfeit, or other unavoidable circumstances, etc.In this case, our company assumes no responsibility at all even if the disadvantages or damages caused by the stop of the service (card use).

Article 13 Setting the security interest such as right of pledge is prohibited

Setting the security rights such as right of pledge to the card is impossible. Moreover, if the customer violates this rule, our company assumes no responsibility at all for the trouble caused by this violation.

Article 14 Changes in agreement

1. This agreement can be changed by our company’s judgment without prior notice.
2. If this agreement is changed, the new agreement will be noticed on our card dealer shops’ and our company’s website for a period prescribed by our company, and all the transactions will be applied with the new agreement starting from the next day of the day when the notice period had ended.

Article 15 Jurisdiction

If the disputes occur with our company regarding with the transactions based on this agreement, the minor court or the local court with jurisdiction over this shop of our company, will be the court of exclusive jurisdiction.
